Careless Storage of a Firearm

Careless storage of a firearm is an offence under section 86 of the Criminal Code. A person may be found guilty of this offence if they store, handle or transport a firearm in a manner that is unsafe and could result in unauthorized access, loss, theft, or accidental discharge.


The law requires firearm owners to:

  • Store firearms unloaded,

  • Keep firearms locked and secure from unauthorized access,

  • Store ammunition separately and securely.


Failure to follow these legal requirements can result in charges of careless storage, even if no harm occurs. Convictions carry serious penalties, including fines, probation, or imprisonment, depending on the circumstances and whether harm resulted.


Defences may include proving compliance with storage regulations, lack of knowledge of improper storage, or that the firearm was secured in a manner consistent with the law. Careless storage charges should be taken seriously to protect personal safety and legal rights.
