Sexual Offences

There are a number of offences relating to illegal sexual activity. Given the seriousness and sensitive nature of sexual offences, there is a unique stigma attached to them.  Furthermore, the penalties can be severe. For that reason, it is crucial that any person accused of committing a sexual offence retain a recognized defence lawyer with extensive experience defending sexual assault and other sexual offences.

Luring

Luring is a criminal offence under section 172.1 of the Criminal Code and involves using the internet or other form of telecommunications to communicate with a person under 18 (or someone believed to be under 18) for the purpose of facilitating a sexual offence.

Child Pornography

Child pornography offences are among the most serious in the Criminal Code and carry significant legal and social consequences. These charges relate to the making, possession, accessing, distribution, or sale of any material that depicts a person under the age of 18 engaged in explicit sexual activity or depicted for a sexual purpose. The law also applies to written materials, audio, and digital images, including those generated artificially.

Sexual Assault

Sexual assault in Canada is governed by the Criminal Code and encompasses a range of non-consensual sexual activities. It is broadly defined to include (a) touching, (b) of a sexual nature, (c) without the consent of the other person. The charge of sexual assault can include kissing, touching to penetration. Consent must be freely given, informed, and can be withdrawn at any time.

Sexual Interference

Sexual interference is a serious criminal offence under section 151 of the Criminal Code of Canada. It involves any sexual touching of a person under the age of 16, whether directly or indirectly, for a sexual purpose. The law applies regardless of whether the young person appears to consent, as individuals under 16 are legally incapable of giving consent to such activity in most circumstances.
